General terms and conditions of business operations and use of the website www.plastikatrcek.si have been drawn up in accordance with the Consumer Protection Act and the applicable legislation for the sale over the Internet and such a way of doing business. The Terms deal with the operation of plastikatrcek.si and business relationship of PLASTIKA TRČEK d. o. o. with registered users (hereinafter referred to as “Users”) and buyers of goods or services (hereinafter referred to as “Customers”).

1. General information about plastikatrcek.si

Plastikatrcek.si is a website used for selling 3D printers, materials for 3D printing, 3D printer accessories and spare parts, as well as various tubes, profiles and panels from thermoplastic elastomers and silicone rubber.

2. Offer and origins

Due to the nature of business the offer on the website may be changed daily. The prices of certain goods encompass regular and special discount prices. TRČEK d.o.o. is responsible for the quality of goods or services, as well as for any complaints or consequences that could arise due to the use of goods or services. PLASTIKA TRČEK d.o.o. is solely responsible for carrying out services or selling goods, and for all related complaints.

Photographs, pictures or videos posted under offers are owned by PLASTIKA TRČEK d.o.o. or its suppliers, business partners, or are only purely symbolic and do not provide the precise characteristics of a product or service, and can show symbolical or actual services, offers, companies or goods.

All goods are original, mostly tracing their origins to the European Union.

3. Purchase and invoice

PLASTIKA TRČEK d.o.o. is a company that provides goods or services over the Internet.

A buyer pays the set amount to the company PLASTIKA TRČEK d.o.o., and together with the goods or service he also receives a bill.

4. Payment methods

Products can be paid in the following ways:

• Payment through PayPal

Delivery of products ordered:

Delivery of products ordered in our online store shall be carried out in the shortest possible time and is subject to availability of products. The products will be delivered to a given address via the GLS courier or other delivery services. We also recommend that you give us your landline or mobile phone number where we can reach you, in order for the courier to be able to call and agree with you on the method of delivery. Your phone number shall be used only for the purpose of improving the quality of delivery.

The package can be delivered to the address that you gave us at the time of the order, or it can be delivered to another given address. It is also possible to personally collect the product, by prior agreement on the telephone number +386 1242 83 60, at the address PLASTIKA TRČEK d.o.o., Cesta v Gorice 35, 1000 Ljubljana, from Monday to Friday between 8 am and 4 pm or by agreement. Before you can collect the product personally it needs to be paid according to pro forma invoice.

5. Offer price

The prices of all offers of goods or services are pre-defined and include VAT. Prices are valid for all customers but only for the duration of individual offers, in the case of payments referred to in these Terms and only on the website “3Dprinters”.

Prices are valid until the moment of delivery of a product. We reserve the right to change the prices.

Prices are rounded off to two decimal places (1 cent).

By registering, the visitor/buyer becomes a user and acquires the right to purchase and access all data of the distance contract.

Distance contract between the seller and a customer is concluded at the moment when the seller confirms the order (the customer receives an e-mail about the status – Order confirmed). From this moment on, all prices and other terms and conditions are set out and apply for both the seller and customer.

By paying the pro forma invoice a customer accepts the General terms and conditions.

6. The process of registration and purchase at plastikatrcek.si

In order for the user to shop on the website plastikatrcek.si he/she first needs to register. Users send their data, email address, shipping address and other information. Username is granted by plastikatrcek.si and represents the name and surname of the user. The password can be set by the users themselves. By registering, the user is enabled to carry out a purchase. Every user automatically becomes a receiving member of our newsletter, which can be subsequently modified in their profile.

• The purchase of services or goods is only possible by prior registration.
• User is assigned a user name which is identical to his/her name and surname, while the password can be created by him- or herself.
• User chooses an offer, selects a payment method and carries out a purchase.
• At the end of the offer (after a certain date or after the purchase of all stocks), the offer is withdrawn from the website or the information “Out of stock” is presented.
• By clicking on “Add to cart” or “Proceed to checkout” the buying process begins, followed by choosing a payment method and carrying out the purchase.

• An information notice concerning the completion of the purchase is sent to the user’s email address.
• The purchase is completed when the payment is made in a proper manner.
• Time limits for payment: it is written in the pro forma invoice.
• Misuse of a purchase is punishable by law.

After sending the order, the customer receives an email notification that the order has been accepted in the queue. The buyer has the right to withdraw from a distance contract within the period before the dispatch of the goods (an order needs to be canceled by email to trcek@siol.net). It is mandatory to write the order number. Email address used to cancel orders must match the email address, which was used in the purchase confirmation. If the customer does not cancel the order, the latter shall be processed further. In order to verify data or to ensure accuracy of the delivery the provider may call the customer on his contact telephone number. Upon confirmation of the order the provider shall inform the customer via email about the scheduled delivery time. At this stage the contract to purchase the ordered products established between the customer and the provider is definitively concluded. Details on distance contracts are always available on the server www.plastikatrcek.si where a subscriber can access with a username and password received at the time of the first order. Prices are valid at the time of sending an order and have no predetermined validity.

7. Personal data protection

When registering or purchasing a customer allows the company PLASTIKA TRČEK d.o.o. to collect, process and store personal data submitted in accordance with the Law on Personal Data Protection. PLASTIKA TRČEK d.o.o. undertakes to carefully and in accordance with the law safeguard any user data. Data are collected on the basis of personal consent of the individual and for an indefinite period or for the time provided by the Law on Personal Data Protection.

Personal data is collected for the purpose of smooth execution of orders or offer, as well as for communication with customers, statistical analysis in order to improve website performance and services, and, if the customer so chooses, for sending notifications, news and offers (via mobile phone, email, in writing to the given address).

In this context, the following data are gathered: IP address, name, address of permanent or temporary residence, date of birth, gender, telephone number, email address, time and date of registration, and archive of communications with the online store. In case of a gift certificate also the name and surname of recipient and his address is collected.

The company PLASTIKA TRČEK d.o.o. respects the privacy of users of the website plastikatrcek.si and undertakes to carefully protect the personal data which will not be given to third parties without consent and will not be used otherwise than exclusively for the above purposes, except in cases where such information would be requested by a competent national authority with a legal basis and in the event that there is suspicion of fraud in dealings of the website user. PLASTIKA TRČEK d.o.o. shall only transmit data to the contract data processor. Entering personal data and payment information is carried out via a secure web form protected with the same or similar encryption mechanisms as those used by banks and other trusted institutions.

The user is also responsible for the protection of personal data, by ensuring the security of his/her username and password, and the appropriate software protection (anti-virus) of his/her computer. Collection of personal data is registered on the website of the Information Commissioner (www.ip-rs.si).

Communication with users is also implemented through social networks with the registered profile PLASTIKA TRČEK. The user can learn of specific offers on the internet site www.plastikatrcek.si, or through advertisements in printed, electronic or online media. An offer on the website will be drawn up in such a way that it will make clear that this is a supply of goods or services with certain discounts, savings or benefits, and stipulate the conditions under which it will be possible to obtain a specific offer.

Users will be able to subscribe to electronic notifications and, if he/she so chooses, to cancel the subscription in an easy and transparent manner. Notifications shall include information on current or future offers, promotion of plastikatrcek.si and other advertisements, or information on its partners. Receiving notifications requires personal consent and receiving is not possible if during the process of registration a user did not specifically declare that he/she wants to receive notifications, or if he/she failed to subscribe in any other way to receiving notifications.

Inquiring procedure will be explained on the website itself, through social media or otherwise. plastikatrcek.si can publish these questions together with the replies. In case of automatic publications plastikatrcek.si reserves the right to delete texts that are abusive, illegal, immoral or punishable by law.

Questions and other texts reflect the opinion of their authors and plastikatrcek.si is not liable in that regard.

10. Complaints and disputes

PLASTIKA TRČEK d.o.o. will try to resolve any ambiguity, dispute or complaint in the shortest time possible, while respecting the laws (The Consumer Protection Act) and shall do its best to reach an agreement.

Comments and complaints are received by the administrative division and dealt with by the legal department. Users can use the following contacts:

The entire process of proceedings is confidential. If an agreement will not be possible, all disputes shall fall under the jurisdiction of the competent court in Ljubljana.

Complaints regarding the quality or the implementation of a certain offer shall be settled between the buyer and PLASTIKA TRČEK d.o.o.

11. Limitation of liability

The website plastikatrcek.si is dealing with catalogue sales of goods and services. Despite efforts to maximize the accuracy and relevance of offers it may happen that the data on goods, services and prices change so rapidly that we might fail to change them and are still published unaltered on the website. In the case of orders of such goods or services the company informs the customer about the changes and cancels the purchase or enables him/her to cancel the contract or agree on another option.

We reserve the right to typographical errors and errors resulting from accidental malfunctions of information and technical system of the website. The company is not responsible for the accuracy of data entered by the customer.

12. The rights of the buyer

It shall be considered that purchases are made through Distance contracts. Language of the contract shall be “SLOVENIAN”.

A customer may request (in writing, by email, by phone or in person) a distance contract and can receive it by mail to his/her address, in electronic form via e-mail or in person at the company’s headquarters.

The buyer is entitled to communicate his/her cancellation of the order within the period of three (3) days from presenting the order to the company and without having to state a reason for his/her decision. If the buyer already paid for the goods, the company shall refund the purchase price paid within fifteen (15) days after receipt of the notice of cancellation. The refund amount will not include costs of the delivery service.

If the buyer has already received the goods he/she has the right to communicate to the company in writing eight (8) days after the receipt that he/she wants to return the goods. Within fifteen (15) days from the written communication, the buyer shall return the goods, in the original packaging and unopened, while PLASTIKA TRČEK d.o.o. shall refund the purchase price paid within fifteen (15) days after the receipt of returned/canceled goods. The refund amount will not include costs of the delivery service.

We shall also replace the goods in the event that a wrong product was dispatched due to our mistake. The purchase price will be refunded upon receipt of returned goods.

The customer shall pay all the shipping costs for returning the goods.

If PLASTIKA TRČEK d.o.o. shall have reason to suspect that a customer deliberately carried out the purchase only to cancel it afterwards, with the intention to deceive or cause harm in any way to PLASTIKA TRČEK d.o.o., the customer shall not be entitled to a refund of the amount paid.

13. Delivery

• The provider will deliver goods or services within the agreed time.
• The contract partner for the delivery of items is GLS or other delivery service.
• Shipping costs are free for orders over € 150 (the price does not include VAT). If the value of order is below € 100 (the price does not include VAT) shipping costs are charged according to the price of the Post of Slovenia.
• The delivery service delivers items in the morning, therefore, you can also choose delivery to any other name or address.
• If at the time of delivery you are not present in the agreed place (company, office, etc.), the deliverer will leave a message, which will include instructions for the subsequent collection.
• If the purchaser does not receive the goods within a few days from dispatch, he/she shall immediately notify the service provider.
• In this case, the provider shall determine the causes and appropriately inform the customer.

Damages in delivery

At the time of accepting a delivery the customer needs to review its content. In the event of damage to the shipment the buyer should return the entire shipment (package, protective packaging, products) to the address of PLASTIKA TRČEK d.o.o. which in turn will provide a replacement shipment.

14. Personal collection of products

Personal collection of products is possible by prior agreement on the telephone number +386 1242 83 60, at the address PLASTIKA TRČEK d.o.o., Cesta v Gorice 35, 1000 Ljubljana, from Monday to Friday between 8 am and 4 pm, or by agreement. Before you can collect the product personally it needs to be paid according to the pro forma invoice issued.
